Issues of Liability for Repeated Petty Theft Under the Criminal Legislation of the Republic of Kazakhstan
Abstract
The article analyzes one of the innovations of the criminal legislation of the Republic of Kazakhstan of 2014 on the problem of repeatedly committed petty theft. In order to ensure the quality of the analysis the article first discusses co- relation of such concepts as the continuous act and repeated offense. According to the author, the need to address these issues is that the body of continuous acts in criminal law is considered as an offense, which indicates the close relationship of the criminal offense and continuous act. As a result of the analysis, some methods of distinction of petty theft committed repeatedly from crimes against property based on the general rules of qualification of crimes are suggested. Taking into account alternative solutions of the problem under consideration, the author offers to exclude liability for repeated petty theft from the Criminal Code Part 2, Art. 187.
