The participation and the role of States in the process of unification of the rules, regulating international trade
Abstract
The article examines the participation and the role of States in the process of the unification of international trade rules. The essence and significance of the institute of international trade law unification lies in the fact, that this the multilateral process allows brining in a single form the relevant legal provisions, reducing the conflict of laws and legal terms and resolving the problem of qualification. The participation of Kazakhstan and the CIS countries in the existing international conventions and agreements in the context of mutual integration has important opportunities for improving national legislation. The author believes that the most appropriate is the need of close cooperation of all States in the framework of international organizations, as adopted international treaties have multilateral universal or regional nature. Particular attention is paid to the norms of «soft law», which have large regulatory capabilities in the field of trade and economic relationships.
