Some features of the subject of medical criminal offenses

With regard to wrongful acts in criminal matters relevant is the question of what kind of criminal offenses committed by health care workers, should be classified as «professional. The criminal legislation of the Republic of Kazakhstan allocates a separate group of criminal offenses committed by medical personnel in the field of health care, in the course of performing their professional duties. The specifics of the criminal responsibility of health professionals related to their subjectivity special status and determined the essence of social performance management and professional health workers. Special subject of a criminal offense stands a person who, in addition to the general subject of the necessary features (and sanity of a certain age), should have a more special additional features, limiting the possibility of the involvement of other persons criminally responsible for the commission of a specific criminal offense. The determining factor in establishing evidence of a criminal offense subject in medical activities is the availability of statutory duty to provide medical care.References
