General description of the institute of recognition of foreign judgments

In article general description of the institute of recognition of foreign judgments are considered. Recognition of foreign judgments represents recognition of validity of this decision, giving of the same validity to it what judgments in this state have. Only after such recognition of the foreign judgment, it can be executed in this state if, of course, this decision demands execution. In the return case, those legal consequences which are fixed by the foreign decision, can take place in the state where the judgment has to be recognized, only after similar recognition of its validity. The emphasis that the civil and procedural code of the Republic of Kazakhstan for definition of the bases of recognition of foreign judgments provides norm according to which, solutions of foreign vessels and arbitration admit and executed in the Republic of Kazakhstan if it is provided by the law or the international treaty of the Republic of Kazakhstan on the basis of reciprocity is placed.
