Legal analysis of the legislation of foreign states in the field of struggling against the creation, use and dissemination of malicious computer programs

Now the process of informatization is going at a fast rate all over the world. Almost all spheres of social life in one way or another depend on the proper functioning of computers, computer systems or information and communication networks. One of the threats to the functioning of computers, their systems and networks are malicious computer programs. For this reason, states develop normative legal acts in order to combat the dissemination of malicious programs, their use, and their creation effectively. In this article legislative acts of some foreign states, directed to the counteraction of the creation, use and dissemination of malicious computer programs are analyzed. Based on the analysis some basic approaches to the criminalization of this computer crime are marked out. Positive and negative sides of foreign legislative acts in considered sphere are noted.Downloads
