Institute of specialist in the criminal trial of the Republic of Kazakhstan: legislative innovations

This article is devoted to analysis of legislative innovations in the use of a specialist institute in legal proceedings, imposed by the criminal procedural legislation of the Republic of Kazakhstan since 2015. The most significant and may be revolutionary was the introduction of procedural rules turnover entitling professionals a written expertise, for the first time recognized in law a source of forensic evidence, along with the conclusion of a forensic expert. Can this fact lead to a confusion of authority mentioned procedural persons (parties)? Another question arising from the evaluation of legislative amendments: one to recognize as «relevant experts» in the case of fixed Code of Criminal Procedure of the Republic of Kazakhstan the right to give their expertise on legal issues. These and other issues were subject of discussion in the presented article.Downloads
