The concept and features of the territorial dispute

Abstract

The article reveals theme theoretical aspects of the concept of the territorial dispute . The comparative characteristics of the concepts of the territorial dispute and the dispute related to the decision of questions of a territorial nature.The author examines different perspectives on the definition of the territorial dispute and based on the study formulates his definition of the research question. Particular attention in their article, the author gives examples of consideration international practices concerning territorial disputes. So, in the article examines the jurisprudence of the International Court of Justice in a dispute between India and Portugal on the right of passage through India and an example to resolve the territorial dispute relating to the delimitation of the continental shelf between the Federal Republic of Germany and Denmark, on the one hand, and between the Federal Republic of Germany and Netherlands – on the other.
