The definition of the crime of genocide and its main forms in the light of the action and the special application of the UN Convention of 1948

Abstract

This article analyzes the legal nature of genocide as an international crime and determination of its major forms with account for the action of a special Convention of the UN of 1948 year from the date of its entry into force. Formed to date, the practice of application of the Convention suggests that it is the emergence of new (or latest) form of genocide accordingly not fixed, not all known in the decisions of international tribunals and courts. Especially it is emphasized that this gap in the Convention should be eliminated in the bodies of the universal organization where it was adopted in 1948.
